General terms and conditions of sale

1/ DESCRIPTION OF THE SERVICE

PetitesCaves (hereafter "the site") is a company specialising in the online sale of wine.

 

2/ PRICES AND PROMOTIONAL OFFERS

All product prices are indicated in euros, including all taxes but excluding participation in shipping costs (see delivery).

PetitesCaves reserves the right to modify its prices at any time without notice. The products will be invoiced on the basis of the prices in force at the time of the recording of the order. The products remain the property of PetitesCaves until full payment is received by PetitesCaves. The price is payable in full and in a single payment.

Promotional offers are valid only within the validity period of the offer concerned and within the limits of available stocks.

 

3/ THE ORDER

The customer can order via the website https://www.petitescaves.com.

PetitesCaves reserves the right to cancel or refuse an order from a customer with whom there is a payment arrears or a dispute relating to the payment of a previous order or for any other legitimate reason, in particular due to the abnormal nature of the order.

When the customer confirms his order, he then declares that he accepts all the present General Terms and Conditions of Sale in their entirety.

The order is then processed by Customer Service. PetitesCaves undertakes to honour orders received via its website only within the limits of available stocks of products. In the absence of availability of one or more products ordered petitescaves.com undertakes to inform the customer as soon as possible.

Petitescaves.com will indicate to the consumer the waiting period for this product or will then propose substitute products.

However, we do allow ourselves to ship the same "wine" (same cuvée) on another vintage when the one proposed (ordered) turns out to be out of stock and/or sold out at Winery.

The customer can, if he wishes, ask for the cancellation of his order, the corresponding amount will then be refunded. As soon as the order is registered, an acknowledgement of receipt will be sent to the customer. This acknowledgement of receipt will detail the order and will specify the exact amount and delivery terms of the order.

The customer accepts that the systems for recording the order at PetitesCaves shall be evidence of the nature of the agreement and its date.

 

4/ PAYMENT

Payment for purchases on the petitescaves.com website is exclusively in euros.

The payment of purchases is made at the choice of the customer.

- by credit card: Visa, Master Card, Cartes Bleues issued in France

- by bank transfer on request

- via Paypal

In case of payment by credit cardIf the customer enters his card number on the site and its expiry date. Online payment by credit card is fully secure. The entire transaction is sent in encrypted mode to a bank validation server (PAYPLUG Groupe NATIXIS BANQUES POPULAIRES).

PetitesCaves reserves the right to verify the personal data communicated by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent payment. The payment is validated upon receipt of the additional information requested.

PetitesCaves will also be free to proceed to the direct cancellation of an order which would present one or more risk factors of fraudulent use of credit card.

 

In case of payment by bank transfer the information necessary for the transfer is provided to the customer. The order will be validated and processed upon receipt of payment on the account of PetitesCaves.

In any case, PetitesCaves reserves the right to refuse any order or delivery in the event of a dispute.

- of existing litigation with the Buyer,

- total or partial non-payment of a previous order by the Buyer,

- of refusal to authorise payment by bank card from banking organisations,

- of non-payment or partial payment,

- the use of a Bank Card not issued by a French financial institution.

The responsibility of PetitesCaves can then in no way be engaged.

 

5/ DELIVERY

Our sales and prices are ex-Mâcon, France.

The products are delivered to the following areas:

- Metropolitan France, Corsica and Monaco: the number of bottles is limited to 54.

For Europe, the number is limited to 30 bottles.

- Germany, England, Belgium, Spain, Italy, Luxembourg, Netherlands,

- Austria, Denmark, Ireland, Portugal, Poland, Czech Republic

- Bulgaria, Croatia, Estonia, Finland, Greece, Hungary, Lithuania, Latvia, Romania, Slovakia, Slovenia, Sweden.

- Australia, Hong Kong, Japan, Singapore, Taiwan

in accordance with the address of your choice as indicated during the ordering process. The delivery service is provided by the classic carriers: GLS, CHRONOPOST, TNT, DHL etc...

The customer will be asked for a contribution to the shipping costs in the order process.

An order placed after 12:00 noon is processed the next day unless it was placed on Friday, in which case the order is processed the following Monday. We do not process orders on Saturdays or Sundays. From June onwards, orders are not processed on Fridays either to avoid weekend heatstroke.

It is up to the customer to provide exactly all the details necessary for the proper delivery of his order. The customer will be delivered within an average of 3 working days* for delivery in France. from the moment the order is taken into account by petitescaves.com (subject to validation of the payment cf paragraph 4. Payment) and within a maximum of 7 working days*.

*this delay may be more important and beyond our control during the holiday season.

 

In case of choice of delivery in a Parcel Relay, the customer has 9 days to collect his package. Beyond this period, the package will be returned to the warehouse of PetitesCaves. For a new delivery, the customer will have to pay the shipping costs + the return shipping costs.

WARNING, on delivery, remember to check the integrity of your products and make reservations to the carrier if necessary. Without reserves on your part, no refund will be possible.

 

6/ RETURN AND REFUND

  1. (a) right of withdrawal

The customer has a statutory period of 14 days to exercise his right of withdrawal from the date of receipt of the goods. The customer will return at his own expense the products that did not satisfy him.

  1. (b) conditions of return

The returned product(s) must be new and unused.

Upon receipt of the package, PetitesCaves will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned products have been visibly used or damaged by the customer and that this use or damage makes the product unfit for sale. If the return is refused by PetitesCaves the products will then be returned to the customer at the expense of PetitesCaves without the customer being able to demand any compensation or right to reimbursement.

If the conditions are met, PetitesCaves will reimburse the customer for the sums paid by him, with the exception of the cost of returning the products to PetitesCaves which remain the responsibility of the client.

8/ INTELLECTUAL PROPERTY

All texts, commentaries, works, illustrations and images reproduced on PetitesCaves are reserved under copyright and intellectual property law and for the entire world. For this reason and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different, or even more restrictive, provisions of the intellectual property code. Any total or partial reproduction of the petitescaves.com website is strictly forbidden without prior agreement.

 

9/ RESPONSIBILITIES

The company PetitesCaves has, for all stages of access to the site, the ordering process, delivery, customer service or subsequent services, only an obligation of means.

 

10/ PROTECTION OF PERSONAL DATA

PetitesCaves reserves the right to collect customer data, in particular through the use of cookies, in accordance with current legislation. Users may expressly object to the disclosure of their contact details. To do so, simply write to Petites Caves, Service Client, 200 boulevard de la résistance 71000 Mâcon. The user is informed that this automated processing of information, in particular the management of user e-mail addresses, has been declared to the CNIL (N°1797994 v 0). In accordance with the French Data Protection Act of January 6, 1978, users have the right to access and rectify data concerning them.
